1. General Provisions

1.1. These Terms (hereinafter — "Agreement") constitute a legally binding contract between you (hereinafter — "User") and ViralExpert.app (hereinafter — "Company", "We").

1.2. By registering, paying for a subscription, or using any functionality of the Service, you confirm your agreement with these Terms. If you disagree, you must not use the Service.

2. Service Description and AI Functionality

2.1. ViralExpert.app provides tools for content creation automation: carousel generation, audio/video transcription, AI copywriting, and analytics.

2.2. Use of Artificial Intelligence: The Service uses third-party provider technologies (Groq, OpenAI, etc.) for content generation.

2.3. Accuracy Disclaimer (AI Disclaimer): Artificial intelligence may make factual errors ("hallucinations"). We do not guarantee that generated text or design will be 100% accurate, unique, or legally compliant. The User is responsible for independently verifying content before publication.

3. Account and Security

3.1. Registration is required for full functionality access. You are responsible for maintaining the confidentiality of your account data.

3.2. Creating multiple accounts by one person to bypass free tier limitations (e.g., 10 download limit) is prohibited. If such actions are detected, We reserve the right to block all associated accounts.

4. Subscriptions and Payments

4.1. Plans: The Service offers limited free access and paid subscriptions (Monthly / Annual).

4.2. Payments: Payment is processed through third-party payment gateways (Lava.top, Stripe). We do not store payment data.

4.3. Auto-renewal: Subscription renews automatically until you cancel it in Account settings.

4.4. Refund Policy:

You may cancel your subscription at any time. Access will remain until the end of the paid period. Refunds for already paid periods are not provided, except in cases of technical failures where the Service was unavailable for more than 24 hours, or as required by your country's legislation.

5. Intellectual Property

5.1. Your Content: You retain all rights to text, images, and videos you upload to the Service, as well as to the final generation results (carousels, PDF).

5.2. License to Service: By uploading content, you grant us a non-exclusive right to use it solely for processing, algorithm operation, and displaying results to you.

5.3. Service Rights: Interface design, source code, logos, and ViralExpert.app algorithms are the intellectual property of the Company.

6. Parsing and Analytics (Scraping)

6.1. By using social media analysis features (Instagram, TikTok, etc.), you confirm that you analyze only publicly available data.

6.2. The User bears sole responsibility for compliance with the Terms of Use of respective social platforms. We provide an analysis tool but are not responsible for blocks of your social media accounts.

7. Prohibited Use

The User is prohibited from:

Using the Service to create fraudulent, offensive, pornographic content or incite hatred.
Attempting to access the Service API bypassing the interface (Reverse Engineering).
Selling access to your account to third parties.

8. Limitation of Liability

8.1. The Service is provided on an "AS IS" basis.

8.2. We do not guarantee any marketing results (virality, reach, likes) from using created content.

8.3. The Company's maximum liability to the User for any claims is limited to the amount paid by the User for using the Service during the last 3 (three) months.

9. Changes to Terms

We reserve the right to modify these Terms. Continued use of the Service after changes means your agreement with the new version.
